Privacy Policy
The confidentiality of your sensitive personal information is important to us. This privacy policy tells you how Innovest Investments (Private) Limited (“Innovest”) uses personal information collected by it. Please read this privacy policy before using Innovest’s website or submitting any sensitive personal information or data. By using our website or upon signing Innovest’s Client Questionnaire, you are accepting this privacy policy. The privacy policy may be revised from time to time and the updated policy will be posted on our website. You are advised to review the privacy policy whenever you visit this website so that you understand how any personal information you provide may be used.
Collection of Information
Innovest, its officers, employees and agents collect information (which can include sensitive personal information) to assist us in our relationship with you. If you are unable to provide the information we need we may not be able to provide you with the service you have requested. We may also be required by law to collect information. The types of information
collected can include:
- Personal identity information such as postal address, email address, etc
- Information which relates to your financial affairs, business, employment, income or assets
- Information which arises or is required in connection with the transactions you do with Innovest or through Innovest
- Information which helps Innovest process applications made by you for particular products and services
- Information relevant for product marketing
- Information from Brokerage Agreements, Managed Account Agreements and other Subscription and Account Opening Documents;
- Information in the course of establishing a customer relationship including, but not limited to, applications, forms, and questionnaires;
- Information about your transactions with Innovest or others
Distribution of Information
While we will not generally disclose your personal information, we may do so if we are
- Required to do so by law, any Government authority, any court order, decree or award,
- Trying to protect against or prevent actual or potential fraud or unauthorised transactions,
- Investigating fraud which has already taken place, or
- Required to do so to market intermediaries, agents, product developers in relation to investments made by you.
Confidentiality and Security
Innovest employees understand the requirement to respect the confidentiality of customers’ non-public personal information and Innovest periodically trains and educates employees in the handling and safeguarding of personal information in accordance with applicable laws, rules, and regulations. Additionally, Innovest maintains physical, procedural and electronic safeguards in an effort to ensure the security and confidentiality of customer records and to protect the information from access by unauthorized parties. Employees who violate these policies are subject to disciplinary action, up to and including termination.
Commitment to Information Security
Your personal information is kept secure. We comply with the relevant security principles set out in the applicable privacy laws of Sri Lanka. We are not bound by privacy laws of any jurisdiction other than Sri Lanka. Only employees of Innovest, its authorised agents and advisors (who have agreed to maintain confidentiality in relation to the information) and market intermediaries and product developers with respect to investments made by you will have access to this information.
Delivery of Privacy Policy
Innovest will provide clients an initial privacy policy notice at the time the relationship is established. Periodically, Innovest may revise the privacy policy and will publish the revised policy on its website.
Client Rights Under the PDPA (Data Subject Rights)
As a client (Data Subject) of Innovest, you are entitled to several specific rights regarding your personal data under the Personal Data Protection Act (PDPA) No. 9 of 2022, a law regulating data processing in Sri Lanka.
Right of Access to Personal Data:
You have the right to request written confirmation as to whether Innovest is processing your personal data, and if so, to access a copy of that data.
- How to Exercise the Right of Access: All requests for access must be made in writing and directed to the Compliance Officer.
- Innovest’s Response Time: We are required to inform you in writing, without undue delay and generally within one month of receiving your request, whether the request has been granted or refused. In complex cases, this period may be extended for a further two months, which will be communicated to you before the initial one-month period expires.
- Refusal and Appeal: If your request is refused, we will provide the reasons for the refusal, and you will be informed of your right to appeal the decision to the Data Protection Authority of Sri Lanka.
Other Data Subject Rights:
You have the following additional rights, exercisable by making a written request to the Compliance Officer:
- Right to Rectification or Completion: The right to request that any inaccurate or incomplete personal data we hold about you is corrected or completed without undue delay.
- Right to Erasure (Right to be Forgotten): The right to request the deletion of your personal data under certain circumstances (e.g., if the data is processed unlawfully or you withdraw consent).
- Right to Withdraw Consent: Where the processing of your data is based on your consent, you have the right to withdraw that consent at any time and request us to refrain from further processing.
- Right to Object to Processing: The right to request us to refrain from further processing your personal data in certain other situations.
- Right to Lodge a Complaint: The right to file a complaint with the Data Protection Authority of Sri Lanka if you believe your rights have been infringed.
